TERMS AND CONDITIONS

 

Covering

1) All mares coming to the stud must have their hind shoes removed.

2) All mares coming to the stud must have up to date tetanus injections.

3) All mares coming to the stud must have a current CEM swab certificate.

4) All mares coming to the stud must have their passports with them.

5) Your mare will receive all reasonable care and attention whilst at this stud, but no responsibility can be taken for any loss, theft, accident, damage or disease howsoever caused.

6) Any veterinary work carried out on your mare will be billed directly to your home address.

7) All stallions are NFFR - no foal free return for up to 2 years, another mare than the one originally sent can be substituted if there is a valid reason for the original mare not to return.

8) All fees for stallions, livery, worming , farrier and vet must be settled before the mare leaves the stud.

 

Design a Foal!

Upon the instigation of design a foal the £500 fee is totally non- refundable.

Holidays

 

 

Livery

1) Your horse will receive all reasonable care and attention whilst at this yard, but no responsibility can be taken for any loss, theft, accident, damage or disease howsoever caused.

2) Livery must be paid one month in advance.

3) All veterinary costs arising for your horse will be billed directly to the owner.

4) No responsibility can be taken for any tack or equipment left by the owner be it lost, stolen or damaged.

Purchasing a horse or foal

1) Terms of Purchase

1.1) All horses / foals are sold on a "sold as seen" basis regardless of whether the animal has been seen in person or just via photos / video footage.

1.2) Estier Stud will provide photos / video footage upon request of the purchaser(s) and is happy to provide its opinion of the horses / foals potential, but cannot guarentee that the horse / foal will always acheive this potential.

1.3) The purchaser must agree that they are satisfied with the condition of the horse / foal prior to its transportation and agree that no reprisals can be made if the conformation / asthetics of the animal do not meet the buyers expectations upon delivery.

2) Payment

2.1) All deposits taken are strictly non- refundable.

2.2) The balancing payment must be paid to Estier Stud before the transportation of the horse / foal has commenced.

2.3) Upon full payment and delivery to the agreed primary destination the horse / foal becomes the responsibilty of the new owner(s) (purchaser(s)). Estier Stud will not take any responsibility if the horse / foal does not meet the owners expectations upon delivery, with the exclusion of the conditions stated in Refunds.

3) Refund(s)

3.1) Estier Stud will provide a refund if the Horse / Foal is delivered with a longterm illness / injury (subject to Transport terms and conditions) upon its delivery at the primary destination to which the purchaser(s) (new owner(s)) were unaware of before the horse / foals transportation had commenced.

3.2) Estier Stud can use its descretion to provide a refund based upon other circumstances if it feels necessary.

3.2) Estier Stud will not provide a refund if the horses / foals conformation/asthetics do not meet the buyers expectations, as the purchaser must confirm that they are satisfied with the horses / foals condition prior to its transportation and all horses / foals are "sold as seen".

4) Transport

4.1) Purchase of a horse / foal by a UK buyer

Estier Stud will pay to have the horse transported to a primary destination in mainland South of England (South of London, excluding the South West and any Islands). At the point in time that the horse / foal is delivered to the agreed primary destination Estier Stud will cease to take any responsibilty for that horse and the new owner(s) (purchaser(s)) will begin to take responsibilty for that horse.

4.2) Purchase of a horse / foal by a French buyer

Estier Stud will agree the transport arrangements with the buyer for delivery to a primary destination. At the point in time that the horse / foal is delivered to the agreed destination Estier Stud will cease to take any responsibilty for that horse and the new owner(s) (purchasher(s)) will begin to take responsibilty for that horse.

4.3) 3rd Party Transport

Estier Stud takes no responsibility for any transport that the buyer(s) arrange(s) or Estier Stud arranges on behalf of the buyer(s) for onward travel of any horses / foals from the primary agreed destination of delivery. Therefore the horse will become in possession of the new owner(s) for any onward travel from the primary destination.
